Stamp duty calculator

What you will pay the Collector of Stamp Duties to transfer land in Kenya, worked out from the Schedule to the Stamp Duty Act (Cap. 480) rather than from a flat percentage. The Schedule charges in whole thousands and rounds the last one up, so on most prices it is not the same number.

The provision this rests on

Stamp Duty Act (Cap. 480), Schedule, item 12A

Conveyance or Transfer on sale of any immovable property (except any debt secured by mortgage or charge on immovable property) situated in any municipality

And for every Sh. 1,000, and also for any fractional part of Sh. 1,000, in excess of Sh. 2,000 … Sh. 40

What this number is not

  • It is not charged on your price if the valuer disagrees. Section 10A requires the Collector to refer the property to the Chief Government Valuer, and duty follows that valuation where it is higher. A bargain purchase does not buy a smaller duty.
  • It is only the stamp duty. Registration fees, legal fees, land rent and rates clearance are all separate and none of them are in this figure.
  • It is for a transfer on sale. A charge or mortgage, a lease, and a transfer of shares each have their own item in the Schedule and their own rate. They are not covered here.
  • “Municipality” is the Schedule’s word, not a county boundary. If you are not certain which side of it your land falls, the Collector decides, and the difference is the whole of 2% of the price.
